Terms of Service
These Terms of Service ("Terms") govern your access to and use of Deepfake Detector ("Service") operated by Deepfake Detector Inc. ("Deepfake Detector," "we," "us," or "our"), a company incorporated in Quebec, Canada with its registered office at 410 rue Saint-Nicolas, Suite 236, Montreal, Quebec H2Y 2P5, Canada. By creating an account, subscribing to a paid plan, calling our API, installing our browser extension, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
01Acceptance & Definitions
These Terms form a binding agreement between you and Deepfake Detector. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you individually and that organization.
For the purposes of these Terms:
- "Account" means the account you create to access the Service.
- "Content" means any audio, video, image, text, or other material you upload, transmit, or submit through the Service.
- "Detection Output" means the verdict, confidence score, and metadata returned by the Service in response to a Content submission.
- "Documentation" means the technical and user documentation we provide, including API reference materials and integration guides.
- "Subscription Plan" or "Plan" means a paid or free tier governing your access to the Service (currently Free, Starter, Business, and Enterprise).
Our Privacy Policy is incorporated into these Terms by reference and explains how we handle personal information.
02Eligibility & Account Registration
You must be at least sixteen (16) years old, or the age of majority in your jurisdiction (whichever is older), to use the Service. If you are using the Service on behalf of an organization, you must be authorized to enter into these Terms on its behalf.
When you create an Account, you agree to:
- Provide accurate, current, and complete registration information;
- Maintain and promptly update your information as it changes;
- Maintain the security and confidentiality of your password and API keys;
- Be responsible for all activity that occurs under your Account;
- Notify us immediately of any unauthorized use of your Account at security@deepfakedetector.ai.
You may not share, sell, or transfer your Account or API keys. We may suspend or terminate Accounts that we reasonably believe have been compromised, used in violation of these Terms, or registered with falsified information.
03The Service
Deepfake Detector is a synthetic-media detection service. We analyze Content you submit and return Detection Output indicating whether the Content shows signs of having been generated or manipulated by AI. The Service is delivered through:
- The web application at deepfakedetector.ai and its subdomains;
- A browser extension distributed via the Chrome Web Store and other supported stores;
- A public REST API documented at deepfakedetector.ai/deepfake-detection-api;
- Direct enterprise integrations under separate Enterprise agreements.
We reserve the right to modify, add, or remove features of the Service at our discretion. We will use commercially reasonable efforts to notify Business and Enterprise customers of material removals at least thirty (30) days in advance.
04Subscriptions, Billing & Refunds
4.1 Plans and pricing
Current pricing is published at deepfakedetector.ai/pricing. Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the term you selected) at the rate in effect at the time of your subscription.
4.2 Authorization
By providing a payment method, you authorize us (or our payment processor, Stripe, Inc.) to charge the payment method for all amounts owed under your Subscription Plan, including recurring subscription fees, any applicable taxes, and overage charges for usage above your Plan's included quota.
4.3 Taxes
Prices are exclusive of value-added tax (VAT), goods and services tax (GST), sales tax, and any other taxes. Where required by law, we will collect and remit such taxes on your behalf.
4.4 Renewals
Subscriptions renew automatically at the end of each billing cycle at the then-current rate unless you cancel before the renewal date. We will provide notice by email at least seven (7) days before any price increase takes effect on renewal.
4.5 Cancellation
You may cancel your subscription at any time from your account dashboard or by emailing billing@deepfakedetector.ai. Cancellation takes effect at the end of the current billing cycle, and you retain access to paid features through that date. You will not receive a prorated refund for the unused portion of a cycle, except as required by applicable consumer-protection law.
4.6 Refunds
Subscription fees are non-refundable except where required by law. UK and EU consumers have a fourteen (14) day right of withdrawal under the Consumer Contracts Regulations 2013 / Directive 2011/83/EU, beginning from the day after subscription. By using the Service to perform a paid detection within that window, you agree that we have begun the service with your express consent and you waive the right of withdrawal for performed services. Unused portions of the subscription remain refundable for the 14-day period.
4.7 Failed payment
If a payment fails, we will retry the payment for up to seven (7) days. After that period, your Account will be downgraded to the Free tier and saved data may be deleted in accordance with our Privacy Policy. We may charge interest on overdue invoices at the statutory rate or 1.5% per month, whichever is lower, where permitted by law.
4.8 Price changes
We may change subscription prices from time to time. For existing subscriptions, price changes take effect at the start of the next renewal term after thirty (30) days' notice by email.
05Free Tier & Trials
The Free tier provides limited access to the Service at no cost. We may modify Free tier features and quotas at any time. Free tier accounts may be suspended for inactivity after twelve (12) months of no usage.
Where we offer a free trial of a paid Plan, the trial converts automatically to a paid subscription at the end of the trial period unless you cancel before then. You may use a free trial only once per individual or organization.
06Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right (including intellectual property and privacy rights);
- Harass, defame, threaten, stalk, or otherwise harm any individual or group;
- Submit Content depicting a person without that person's consent, where doing so would violate that person's rights of privacy or publicity;
- Submit Content involving the sexual exploitation of minors or non-consensual intimate imagery (we report such Content to law enforcement and applicable child-safety hotlines including NCMEC);
- Use the Service to facilitate or further fraud, including identity fraud, financial fraud, or impersonation for the purpose of fraud;
- Generate, distribute, or amplify disinformation, election misinformation, or AI-generated content designed to deceive (we are a detection service; using us to launder deepfakes through a "verified authentic" claim is strictly prohibited);
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or training data underlying the Service;
- Probe, scan, or test the vulnerability of the Service except under a coordinated disclosure agreement with us;
- Circumvent rate limits, quota enforcement, authentication mechanisms, or other technical access controls;
- Resell, rent, sublicense, or otherwise commercially exploit the Service except as expressly permitted under your Subscription Plan;
- Use the Service to compete with us, including by using Detection Output to train a competing model;
- Upload malware, viruses, or other malicious code;
- Impose an unreasonable load on the Service through automated requests beyond the limits of your Plan;
- Collect or harvest personal information of other users.
We may investigate any suspected violation and take action up to and including immediate suspension or termination of your Account, removal of Content, and referral to law enforcement.
07Your Content & Submitted Media
7.1 Ownership
You retain all rights, title, and interest in and to the Content you submit. We claim no ownership of your Content.
7.2 License you grant to us
You grant Deepfake Detector a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, analyze, and display your Content solely to the extent necessary to provide the Service, deliver Detection Output to you, secure the Service, comply with legal obligations, and—only where you have explicitly opted in via a separate consent mechanism—improve our detection models. This license terminates when you delete the Content or when your retention period expires under our Privacy Policy, whichever comes first.
7.3 Your representations
By submitting Content, you represent and warrant that:
- You own the Content or have all necessary rights, licenses, consents, and permissions to grant us the license in Section 7.2;
- The Content does not violate any third-party right, including intellectual property, privacy, publicity, or moral rights;
- Your submission and our processing of the Content does not violate any applicable law, including data-protection law (where the Content includes personal data, you have a lawful basis to provide it to us as a processor or to authorize us as a controller);
- The Content does not contain malware or other malicious code.
7.4 Storage and deletion
By default, Content is processed in memory and deleted from primary storage within sixty (60) seconds of analysis completion. If you opt into retention (for example, to maintain a history of detection results in your dashboard), retention periods are described in our Privacy Policy.
7.5 Detection Output
We grant you a worldwide, non-exclusive, perpetual license to use the Detection Output for your own internal business purposes, including external publication of verdicts in news reporting, research, and litigation. You may not represent Detection Output as an unconditional guarantee of authenticity, and you must disclose Deepfake Detector as the source where verdicts are published externally for editorial use.
08Intellectual Property
The Service, including all software, models, algorithms, user interfaces, branding, trademarks, and documentation, is owned by Deepfake Detector Inc. and protected by intellectual property law. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business or personal purposes.
You may not:
- Copy, modify, distribute, or create derivative works of the Service;
- Remove or alter any proprietary notices on the Service;
- Use our trademarks, logos, or branding without our prior written consent, except for fair-use journalistic, editorial, or comparative-advertising purposes consistent with applicable law;
- Use the Service to develop a competing service.
If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use the Feedback without restriction or compensation to you.
09API Terms
If you access the Service through our public API, the following additional terms apply:
- API keys. API keys are issued per Account and must be kept confidential. You are responsible for all activity initiated with your API key. Rotate keys promptly if compromise is suspected.
- Rate limits. Rate limits are documented in your Plan and may be adjusted with reasonable notice. You agree not to exceed published limits or to circumvent them through multiple Accounts.
- Caching. You may cache Detection Output for up to 24 hours for the same input. You may not cache or republish Detection Output for longer periods without our written consent.
- End-user disclosure. If you embed the Service into a product offered to end users, you must disclose to those end users that detection is provided by a third-party service and link to our Privacy Policy if their personal data is being processed.
- SLA. Business and Enterprise plans include a service-level agreement (SLA) with uptime commitments and service credits. Free and Starter plans are provided on a best-effort basis without SLA.
- Versioning and deprecation. We may release new API versions and deprecate old ones. We will provide at least ninety (90) days' notice before sunsetting an API version that customers actively depend on.
10Detection Accuracy & Limitations
You acknowledge and agree that:
- The Service may produce false positives (identifying authentic media as synthetic) and false negatives (failing to identify synthetic media);
- Detection accuracy varies by media type, generator model, file quality, encoding artifacts, and adversarial manipulations;
- You are solely responsible for decisions you make on the basis of Detection Output;
- For high-stakes use cases, including financial transactions, identity verification, legal proceedings, journalism, and law enforcement, you should perform additional out-of-band verification and obtain expert review;
- We make no representation that the Service will detect every form of synthetic media or every future generator model.
11Service Availability & Changes
We use commercially reasonable efforts to keep the Service available and operating. However, we do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, force majeure events, third-party provider outages, or security incidents. We will use commercially reasonable efforts to provide advance notice of scheduled maintenance.
We may modify, suspend, or discontinue any feature of the Service at any time. For Business and Enterprise customers, we will provide at least thirty (30) days' notice of any material feature removal. For Free and Starter customers, we may make changes without advance notice.
12Term & Termination
12.1 By you
You may terminate these Terms at any time by closing your Account through your account dashboard or by emailing hello@deepfakedetector.ai. Termination takes effect at the end of your current billing cycle.
12.2 By us
We may suspend or terminate your access to the Service immediately and without notice if you:
- Materially breach these Terms, including the Acceptable Use Policy;
- Fail to pay any amount when due and do not cure within seven (7) days of notice;
- Use the Service in a manner that creates legal, regulatory, or reputational risk for us;
- Submit Content that violates law or third-party rights;
- Are determined by us, in our reasonable judgment, to pose a security or fraud risk.
12.3 Effect of termination
Upon termination, your right to access the Service ceases, and we may delete your Account, Content, and Detection Output in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Sections 8, 10, 13, 14, 15, 16, 17, and 19) will survive.
13Disclaimers of Warranties
Without limiting the foregoing, we do not warrant that (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the Service will be accurate or reliable; or (d) any errors in the Service will be corrected.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence, or—under UK and EU consumer law—certain implied terms in consumer contracts.
14Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT WILL DEEPFAKE DETECTOR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
- OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
The limitations in this Section apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and even if any limited remedy fails of its essential purpose. They do not apply to liability that cannot be excluded or limited by applicable law (see Section 13).
15Indemnification
You agree to indemnify, defend, and hold harmless Deepfake Detector and its affiliates, officers, directors, employees, and agents from and against any third-party claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service in violation of these Terms or applicable law;
- Content you submit, including any claim that the Content infringes a third-party right;
- Your breach of any representation or warranty in these Terms;
- Decisions you make on the basis of Detection Output, including any reliance on Detection Output in connection with high-stakes use cases described in Section 10.
We will (a) promptly notify you of any indemnified claim; (b) give you sole control of the defense and settlement (provided you may not settle a claim without our prior written consent if the settlement requires us to admit fault, pay money, or take or refrain from any action); and (c) provide reasonable cooperation at your expense.
16Governing Law & Jurisdiction
These Terms and any dispute arising out of or in connection with them or their subject matter are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. Subject to Section 17, the courts of the Province of Quebec, district of Montreal, have exclusive jurisdiction over any dispute.
If you are a consumer resident in the European Union, you also have the protection of mandatory provisions of the law of the country in which you live. Nothing in this Section affects your statutory rights as a consumer.
17Dispute Resolution
Before initiating formal legal proceedings, the parties agree to attempt in good faith to resolve any dispute through informal negotiation. Either party may initiate the negotiation process by sending written notice to the other party identifying the dispute and the relief sought.
If a dispute cannot be resolved through negotiation within sixty (60) days of notice, the dispute will be resolved through binding arbitration administered by the ADR Institute of Canada (ADRIC) under its Arbitration Rules then in force, with the seat of arbitration in Montreal, Quebec, Canada, and the language of arbitration in English. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights pending arbitration.
EU consumers: If you are a consumer resident in the EU, you may submit a complaint to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are, however, not obliged to participate in alternative dispute-resolution proceedings before a consumer arbitration board.
18Changes to these Terms
We may modify these Terms from time to time. For material changes, we will notify you by email or through the Service at least thirty (30) days before the changes take effect. For non-material changes, we may post the updated Terms with a new "Effective" date without separate notice.
Your continued use of the Service after the Effective date of updated Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may close your Account in accordance with Section 12.1.
19General Provisions
19.1 Entire agreement
These Terms, together with the Privacy Policy and any Plan-specific terms or order forms, constitute the entire agreement between you and Deepfake Detector regarding the Service and supersede all prior agreements, communications, and understandings.
19.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
19.3 No waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver must be in writing and signed by an authorized representative of Deepfake Detector to be effective.
19.4 Assignment
You may not assign these Terms or any rights under them without our prior written consent. Any unauthorized assignment is void. We may assign these Terms without your consent in connection with a merger, acquisition, sale of assets, or by operation of law.
19.5 Third-party beneficiaries
These Terms do not confer any rights on any third party except as expressly stated. No person who is not a party to these Terms has any right to enforce any term, except as expressly provided herein or as required by applicable law.
19.6 Force majeure
Neither party will be liable for any delay or failure to perform under these Terms (other than the obligation to pay money) caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, labor disputes, power or telecommunications failures, or third-party service-provider outages.
19.7 Notices
Notices to Deepfake Detector must be sent to the email address listed in Section 20 and to our registered office. Notices to you will be sent to the email address associated with your Account or posted within the Service.
19.8 Export controls
You agree to comply with all applicable export-control and sanctions laws, including those of the United Kingdom, the European Union, and the United States. You represent that you are not located in, or a national of, a country subject to a comprehensive embargo, and that you are not on any government list of restricted parties.
